Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FrenchPrep platform ("Platform", "Service"), operated by Whitelen Technologies Inc. ("Company", "we", "us", "our"), a company incorporated in British Columbia, Canada, with principal offices in Vancouver, BC.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Service Description

FrenchPrep is an online teaching operating system designed to help students prepare for TEF Canada and TCF Canada French language examinations. The Platform provides practice exercises, mock exams, audio content, instructor management tools, and related educational features.

The Platform is a licensed access service. Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform's content and features during their active subscription period.

2. Account Registration

To use the Platform, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately at base@whitelen.com if you suspect unauthorized access. Accounts are personal and non-transferable.

3. Subscription and Payment

3.1 Billing

FrenchPrep operates on a monthly subscription model. Payments are processed securely through Stripe. By subscribing, you authorize recurring monthly charges to your payment method until you cancel.

3.2 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing cycle. You will retain access to the Platform until the end of the paid period. No partial refunds are provided for unused portions of a billing cycle.

3.3 Price Changes

We reserve the right to modify subscription pricing. You will be notified at least 30 days before any price change takes effect. Continued use after the effective date constitutes acceptance of the new pricing.

4. Center and Instructor Accounts

Organizations ("Centers") and instructors who manage student accounts are additionally responsible for ensuring that their students comply with these Terms. Centers may not exceed their licensed student or instructor limits. Instructor accounts are subject to the same content restrictions as student accounts.

5. Acceptable Use

You agree to use the Platform solely for personal educational purposes. You must not use the Platform for any unlawful purpose, interfere with its infrastructure, attempt to access other users' accounts, upload malicious content, or impersonate any person or entity.

6. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or Platform notification. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

7. Intellectual Property

We invest significant effort in creating high-quality exam preparation content. All materials on the Platform — including practice questions, audio recordings, explanations, mock exams, scripts, and software — are owned by Whitelen Technologies Inc. and protected by Canadian and international intellectual property laws. Your subscription grants you access to use these materials for your learning; ownership and distribution rights remain with us.

8. Content Usage

Access to Platform content is granted solely for use within the Platform for the purpose of exam preparation and instruction. All content remains the exclusive property of Whitelen Technologies Inc.

Any unauthorized use, reproduction, or distribution of Platform content — in whole or in part, by any means — constitutes a violation of these Terms and applicable intellectual property laws, and will be pursued accordingly.

All Platform content is protected by technical and forensic measures, including digital watermarking, that enable us to identify and trace any content to its source.

9. Account Suspension

We hope it never comes to this, but we reserve the right to suspend or terminate accounts that violate these Terms or engage in activity that is harmful to the Platform or other users. If your account is terminated, access to the Platform will cease and we are not obligated to retain your data beyond what is required by law.

10. Disclaimer

The Platform is provided on an "as is" basis. While we work hard to keep everything running smoothly, we cannot guarantee uninterrupted service or that all content will be error-free at all times. We also cannot guarantee specific exam results — your outcomes depend on many factors beyond the Platform.

11. Limitation of Liability

To the extent permitted by law, Whitelen Technologies Inc.'s total liability for any claims related to the Platform is limited to the subscription fees you have paid in the twelve (12) months before the claim. We are not liable for indirect or consequential damages.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.
